On the Law Promulgated in Bulgaria
The President of Bulgaria has promulgated a Law, which has also been published in the Official Gazette of Bulgaria and entered into force on 16.08.2024, a Law prohibiting the “propaganda, promotion or incitement” within the educational system of “ideas and opinions linked to non-traditional sexual orientation and/or to a gender identity other than the biological one”.
The progressives were scandalised… but they rejoice that here it could not be done.
Romanian conservatives look towards the Bulgarians with longing. And they are frustrated that here it still cannot be done…
Yet few now recall that such legal provisions have already been published in the Official Gazette of Romania! As long ago as 2021!!!
More precisely, in the Official Gazette of Romania no. 925/28.IX.2021, Article 6 provided for the amendment of Law no. 272/2004 on the protection and promotion of the rights of the child, introducing express provisions for the defence of the physical and mental integrity of the minor, in his capacity as a citizen and holder of rights. Thus there was prohibited, until the age of 18, any form of intervention upon the body of the minor having as its purpose the alteration of the sexual identity acquired at birth. At the same time there was prohibited the making available to children of any material of a pornographic character or promoting departure from gender identity, such material being capable of causing psychical traumas that will mark the citizen’s whole existence. In adopting these amendments, account was taken both of the superior interest of the child and of his right to decide and to dispose knowingly of his own body once he has attained psychical maturity, with a view to eliminating any premature influences upon the normal physical and psychical development of the Romanian citizen. Not least, account was also taken of the irreversible character of any premature gender alteration — alterations that will have a negative effect both upon the development of the minor and, directly, upon the birth rate in Romania through gender changes carried out during minority, an aspect which directly affects national sovereignty.
Indeed, certain deeds committed against minors were even brought within the criminal sphere: in Article 9, paragraph 2 amends Art. 197 of the Criminal Code, under the marginal heading “Ill-treatment inflicted upon a minor”, introducing two new paragraphs, namely paragraphs 2 and 3. Paragraph 2 of Article 197 criminalises “The deed of causing a minor who has not attained the age of 18 to alter his biological sexual identity acquired at birth”, whether or not that deed achieved the end pursued by the perpetrator. The reason for criminalising this deed lies in the grave mental, psychical and behavioural disturbances such a deed may bring upon the minor, even though the minor cannot by himself dispose of the actual, physical alteration of his sexual identity acquired at birth. Paragraph 3 introduces an aggravated form of the deed provided for in paragraph 2 as introduced by the present draft law, increasing by one third the punishment applied to the perpetrator where he is a parent, guardian, teacher or professor, or where the deed itself has produced physical consequences upon the minor, whatever the standing of the perpetrator.
And it went much further than the Bulgarians ever imagined: by paragraph 4 of Article 9 of the Law, paragraph 4 of Article 221 of the Criminal Code is amended, raising from 13 to 14 the age from which the deed of causing a minor to witness the commission of acts of an exhibitionist character, or shows or performances in which sexual acts of any nature are committed, is punished.
At the same time, the deed of making available to a minor material of a pornographic character or with content explicitly describing sexuality was likewise criminalised. Account was taken of the necessity of preserving the innocence and the natural development of the minor in accordance with the moral norms generally accepted by society, up to an age at which the criminalised deeds lose their danger and are no longer capable of affecting the minor’s psychical development.
Likewise brought within the sphere of criminal illegality was the deed of making available to a minor any material of a pornographic character or with content explicitly describing sexuality, regard being had to the superior interest of the minor and to the negative impact of pornographic material, or material explicitly describing sexuality, upon the psyche of minors and upon their development at a tender age.
And no, not only that! The Romanians went further still in their boldness: in their “criminal recklessness towards political correctness”, the authors of these retrograde legal norms published in the Official Gazette no. 531 of 7 June 2024 an amendment to the Constitution of Romania whereby, after paragraph (3) of Article 22, paragraph (4) was introduced, expressly providing that “(4) The biological sexual identity of the child acquired at birth may not be altered until the age of 18.”
All of this, and many other precise solutions to vital problems of today’s Romania, have already been published in the Official Gazette of Romania. But they were not adopted by Parliament nor promulgated by the President… for they were “only” two popular legislative initiatives, namely #TheSovereigntyLaw and #TheConstitutionOfSovereignty. Both were ardently sabotaged by the overwhelming majority of Romania’s “sovereigntists”, and the first bill — #TheSovereigntyLaw, the very fount of “sovereigntism” in Romania — was furiously rejected in Parliament by the PSD–PNL #CoalitionOfTreason.
That is how history was written. God alone knows what is to come!
For my part, having become a mere onlooker, my conscience is at peace and I consider that I did all I could… and more besides!
And I make bold to offer just one humble suggestion to the great sovereigntist politicians whose names I am not even worthy to mention: do not be ashamed — copy! Copy from the Official Gazette of Romania no. 925/28.IX.2021 and from the Official Gazette no. 531 of 7 June 2024!!!
And the Romanians will be the better for it. And you, as illustrious politicians, will have the chance to enter history!
