The Bill and the Trafficking of Minors (II)
#TheSovereigntyLaw amends art. 211 of the Criminal Code — “Trafficking in minors” — and brings within the sphere of criminal illegality the act of mediating or encouraging the adoption of children by any person who is not a public servant and whose duties do not include the adoption of minors.
This because for far too long the children of Romania have been a commodity!
Because many have made fortunes from this occupation, which has become a mega-business; some have even become Presidents…
Because the future of Romania is not for sale.
Article 9
Law no. 286 of 17 July 2009 on the Criminal Code, published in the Official Gazette no. 510 of 24 July 2009, as subsequently amended and supplemented, is amended and supplemented as follows: (…)
(3) In article 211, after paragraph (1), a new paragraph is introduced, para. (11), with the following content:
“The mediation or encouragement of adoptions by persons who do not have the capacity of officials within the General Directorate for Social Assistance and Child Protection or the National Authority for the Rights of Persons with Disabilities, Children and Adoptions is punished by imprisonment of from 7 to 15 years and the prohibition of the exercise of certain rights. (…)”
“Article 9 amends Law no. 286/2009 — the Criminal Code, bringing the legislation in this field into accord with the latest decisions of the Constitutional Court, and also with the legislative amendments introduced by the present legislative proposal. (…)
Paragraph 3 of article 9 amends art. 211 of the Criminal Code, with the marginal heading ‘Trafficking in minors’, introducing after paragraph 1 a new paragraph, (11), by which there is criminalised the Mediation or encouragement of adoptions by persons who do not have the capacity of officials of the General Directorate for Social Assistance and Child Protection or of the National Authority for the Rights of Persons with Disabilities, Children and Adoptions. As the reason for criminalising this act there was taken into account the situation of the last decades, in which the adoption of children was seen by various natural and legal persons as a veritable act of commerce — thousands of children being thus taken out of the country, losing their citizenship and no longer being capable of protection by the Romanian state, a fact which affects in a direct and grave manner national sovereignty through the diminution of the population, the holder of sovereignty.”
