The Protection of Children’s Identity

#TheSovereigntyLaw makes impossible the changing of the sexual identity of children and forbids the propaganda that promotes departure from biological sexual identity, gender reassignment and homosexuality.

Article 6

Law 272 of 21 June 2004 on the protection and promotion of the rights of the child, republished, published in the Official Gazette no. 159 of 5 March 2014, as subsequently amended and supplemented, is amended and supplemented as follows:

(1) In article 9, after paragraph (1), a new paragraph is introduced, para. (11), with the following content:

“The biological sexual identity of the child acquired at birth may not be modified before the age of 18.”

(2) In article 28, after paragraph (4), a new paragraph is introduced, para. (5), with the following content:

“It is forbidden to make available to children under the age of eighteen any information or materials that promote departure from biological sexual identity, gender reassignment and homosexuality.”

(3) In article 46, paragraph (3), letter i) is amended and shall have the following content:

“the systematic conduct in school units, at least once per semester, of programmes of education for life, including sexual education for children over 14, with a view to preventing the contracting of sexually transmitted diseases and the pregnancy of minors;”

Explanatory Memorandum:

Article 6 amends Law 272/2004 on the protection and promotion of the rights of the child, introducing provisions concerning the defence of the physical and psychic integrity of the minor, in their capacity as a citizen holding rights. Thus, until the age of 18 there is forbidden any form of intervention upon the body of the minor having as its purpose the modification of the sexual identity acquired at their birth. At the same time there is forbidden the making available to children of any materials of a pornographic character or promoting departure from gender identity, such materials being liable to be the cause of psychic traumas that will mark the citizen’s whole existence. In adopting these amendments account is taken both of the higher interest of the child and of their right to decide upon and dispose of their body in full knowledge after the moment of attaining psychic maturity, any possible premature influences upon the normal physical and psychic development of the Romanian citizen being thereby eliminated. Not least, account is also taken of the irreversible character of any premature gender modifications — modifications which will have a negative effect both upon the development of the minor and, directly, upon the birth rate in Romania through gender changes performed during minority, an aspect which directly influences national sovereignty.”
